Article 3 : Prices and Payment Methods
3.1. Prices
The prices mentioned on the Site are valid at the time of ordering. They are indicated and invoiced in Euros including all taxes (amounts excluding tax specified in the order summary). They do not take into account delivery costs, which are invoiced in addition, and clearly indicated by the mention "shipping costs" before the order is validated by the Customer. The mention "shipping costs" is always indicated, even when the amount is zero (in the case of an order for rations for example). The prices displayed are subject to change without notice and at any time (before order validation). Prices take into account the VAT applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the price of the Products offered on the Site. Payment of the full price must be made at the time of ordering.
3.2. Payment Methods
The Customer must pay for their order immediately on the Internet by credit card (Visa, MasterCard, other Credit Cards). The payment is made on the secure server of our bank, Crédit Mutuel, which ensures total security and confidentiality. The information requested from the Customer concerning his bank card is only transmitted to Crédit Mutuel. The Company will not know the Client's credit card information at any time.
Payment of the annual subscription of a veterinary clinic may result in payment by cheque. In the latter case, the subscription is only effective upon receipt and cashing of the cheque made out to A.N.E. Payment for products by cheque is reserved for veterinarians only, subject to prior request and acceptance by the Company. A Customer's order will only be considered effective from the moment the payment center has given its approval. In the event of a refusal by Crédit Mutuel, the order will be automatically cancelled.
Article 4 : Delivery
4.1. Delivery of the Recipe
The Company undertakes to make available on the profile of the animal for which the recipe has been ordered, the individual tailor-made recipe as soon as the payment is validated. (Manage my Animals section> in the animal's file, click on "Show information" > "Recipes").
4.2. Products shipping
Products ordered on the Site will be shipped to Metropolitan France by Colissimo Expert or Chronopost (different rates), at the choice of the Customer, who must tick the option chosen at the time of ordering. By choosing Colissimo Expert, delivery is guaranteed in five (5) working days from the day following the day on which the payment by the Customer has been accepted by Crédit Mutuel for payments by credit card. With Chronopost, delivery is guaranteed in forty-eight (48) to seventy-two (72) hours on working days. For deliveries in Europe, only Colissimo Expert is offered.
The Company organizes the shipment of products within 24 hours of the first working day after the validation of payment of an order (more precisely, the order is taken care of at 7 am the day after the order is validated and processed and shipped before 5 pm). Then, the delivery time guarantee is that of Chronopost (delivery before 6 p.m. the day after shipment) or Colissimo expert (72 hours after shipment in France). For more information, see the respective websites of Chronopost and Colissimo expert. For both types of delivery, the parcel is delivered against the recipient's signature. In case of absence, a pending notice is left in the recipient's mailbox.
The Company cannot be held responsible for a failure to inform Chronopost or Colissimo. As soon as the Products are shipped, the delivery tracking number and the delivery method (Colissimo or Chronopost) are available on the invoice, which can be consulted by the Customer by logging into their account on the Site. The Customer can then track their delivery by entering this number on the Colissimo or Chronopost website. The Products will be delivered to the address indicated by the Client when creating their account, the delivery address may be different from the billing address, but must be in the same country.
Upon receipt of the order, the Client must verify the conformity of the Products received. Any apparent anomaly concerning the delivery (missing or broken Product, damaged package, etc.) must be notified, ideally with a photo, as soon as possible to the Company's customer service, by letter addressed to the Company, or by e-mail sent via the contact form available on the site, or to contact@cuisine-a-crocs.com, or by telephone from France 06 72 48 78 85, from abroad +33 764097273. The Company reserves the right to ask the Client to return the defective Product. The Company will then proceed either to the exchange, or to the refund of the defective Product(s), or to the re-shipment of the missing Product (subject to the merits of the Client's request).
Article 5 : Right of withdrawal
5.1. Tailored recipes, subscription and coaching
Given the personalized nature of the service and the fact that the performance has begun with the Client's agreement before the end of the withdrawal period, the Client acknowledges and accepts that the right of withdrawal within a period of fourteen (14) from the delivery of the services/products provided for in distance selling, can no longer be exercised by the latter, in accordance with the provisions of Articles L 221-28 et seq. of the Consumer Code. The purchase of any RECIPE is therefore firm and definitive and cannot give rise to any exchange or refund.
5.2. Products
WITHDRAWAL PERIOD After having placed, validated and paid for your order (which amounts to subscribing to the sales contract), you have the right of withdrawal without penalties of 14 calendar days in accordance with articles L221-28 et seq. of the Consumer Code.
Products must be returned to the following address: ANE (Site cuisine-a-crocs.com) 24 ZA Lana, 9 Lana Leku Street, 64210 Arbonne, France, quoting order and invoice numbers. Only products returned in their entirety, in their original packaging complete and intact, and in perfect resalable condition, will be returned.
Any product that has been damaged, or whose original packaging has been damaged, or whose tamper-evident ring has been removed, will not be refunded or exchanged.
REFUND TERMS AND DEADLINES
In the event of exercising the right of withdrawal, the Client has the choice of requesting either a refund of the sums paid (price of the Products including standard delivery costs), or the exchange of the Products (via a Credit Note, the costs of return and redelivery remain at the expense of the buyer), or a Credit Note (corresponding to the price of the products and valid on the entire site). In the event of a refund, the Company will reimburse the Client, within fourteen (14) days from the date of receipt by the Company of the parcel (the date of receipt by the Company is equivalent to notification to the Company of the Client's exercise of its right of withdrawal). In the case of an exchange, the re-shipment will be at the Customer's expense.
For further details, check le site du service publicSUMMARY OF THE PROCEDURE: to exercise your right of withdrawal, before the expiry of the withdrawal period, you must express to us in writing (preferably by email to contact@cuisine-a-crocs.com) your wish to withdraw, specifying your name, address, the number and date of your order and the products concerned. Simply returning the package without a declaration or refusing to take delivery is not enough to express your desire to withdraw.
Article 6 : Responsibility
The Company cannot be held responsible for a medical problem concerning the animal in the following cases:
- Use of a Household Ration for an animal different from the one for which it was formulated, or for the same animal but whose living or medical conditions have changed;
- Incomplete or erroneous declaration by the Client in the form;
- False declaration, concerning the state of health or characteristics of the animal, regardless of the person who filled out the form;
- Non-application of the indicated homemade or mixed diet, or failure to follow up on the indications provided, including adjustments according to changes in body weight, dietary transitions,...;
- Change in quantity or ingredients without a request for information as to the appropriateness of such a change from the Company;
- No request for information or change within forty-eight (48) hours of receipt of the Homemade Ration in the event that it does not suit the owner of the animal for any reason;
- Failure to comply with the conditions of use indicated on the product leaflets (dose, age of the animal, etc.) or when establishing a household or mixed ration, in the advice sent. The mineral and vitamin supplementation of a homemade or mixed diet is understood daily. The Company shall not be liable for any irregular distribution. In addition, a supplement intended to balance a homemade diet cannot be added without risk to an already complete ration.
Article 7 : Personally identifiable information and confidentiality
This site has been declared to the CNIL under the number 1321592. All data is secured, via dedicated server hosting.
7.1. Customer information
The information requested from the Client by the Company is necessary for the processing of his order. The Client may freely choose, in accordance with the French Data Protection Act, to accept to receive information/promotions by email/post/SMS from Cuisine-a-croc.com and independently of Cuisine-a-croc.com's partners. The Client has the right to access, rectify, modify and delete data concerning him/her. Customer may exercise this right by writing to the Company, ANE (cuisine-a-crocs.com Site), 24 ZA Lana, 9 Lana Leku Street, 64210 Arbonne, France or by email at contact@cuisine-a-crocs.com.
7.2. Information about the dog or cat transmitted via the form
The Company reserves the right to use, in a completely anonymous manner, all information transmitted (excluding name and contact details) for statistical and scientific purposes, and for commercial purposes within the framework of the Company's activity only.
7.3. False information
Under the terms of Article 313-1 of the Criminal Code, "the fact (...) by the use of a false name or a false capacity (...) to deceive a natural or legal person and thus to induce him, to his prejudice or to the prejudice of a third party, to hand over funds, securities or any property whatsoever, to provide a service or to consent to an act operating an obligation or discharge" constitutes the offence of fraud punishable by a maximum penalty of five years' imprisonment and a fine of 375,000 euros. Under the terms of Article 441-1 of the Criminal Code, "A forgery is any fraudulent alteration of the truth, likely to cause harm and carried out by any means whatsoever, in a writing or any other medium of expression of thought which has as its object or which may have the effect of establishing proof of a right or a fact having legal consequences". The offence is punishable by 3 years in prison and a fine of 45,000 euros.
Identity theft can be appealed whether or not the victim of identity theft has suffered damage. (Articles 544 and 1382 of the Civil Code and Case Law: "the plaintiff must be protected against any usurpation of his name even if he has not suffered any prejudice as a result." (TGI Marseille, 9 February 1965, D. 1965 270)).
Article 8 : Intellectual Property
Cuisine-a-crocs.com site is the property of the company Animal Nutrition Expertise. All elements of the Site (texts, photos, graphic elements, recipes, all downloadable or non-downloadable documents, etc.) belong to the Company. The site is protected by intellectual property laws. It is strictly forbidden to reproduce it, in its form or content, in whole or in part, without the written consent of its author.
This representation or reproduction, by any process whatsoever, constitutes an infringement punishable by articles L.3335-2 et seq. of the Intellectual Property Code.
